Full Probate services for a low fixed fee

Our Services

Probate for $770

We provide a full service in order for you to obtain the Grant of Probate, which includes:
meeting with you, preparing the necessary documents to obtain the Grant of Probate, meeting with you again to execute the documents, filing the documents with the court
Our fees for providing this full Probate service are $770 (plus the Supreme Court Probate filing fee of $344)

Letters of Administration from $990

We provide a full service in order for you to obtain the Letters of Administration, which includes:
meeting with you to discuss all the possible issues, preparing the necessary documents to obtain the Letters of Administration, meeting with you and the other persons who have an interest in the estate to execute their affidavits, and filing the documents with the court
Our fees for providing this full Letters of Administration service are from $990 (plus the Supreme Court Probate filing fee of $344)

Resealing Probate for $880

If you have already obtained probate in one State or Crown jurisdiction (NZ, England or Canada) and need to obtain probate in one or more other jurisdictions (ie WA), we can provide a full service for you to have the probate resealed in such other jurisdictions.
Our full services includes:
meeting with you, preparing the necessary documents to have the probate resealed, meeting with you again to execute the documents, and filing the documents with the court
Our fees for providing this resealing of probate service are $880 for the WA jurisdiction (plus the Supreme Court Probate filing fee of $344)

What is Probate?

Probate is the process of registering a deceased person’s Will in the Supreme Court so the named executor under the Will can deal with the deceased’s assets (ie property, bank accounts and shares) and administer them according to the Will (or otherwise pursuant to a Deed of Family Arrangement).

Do I need Probate?

If the deceased died leaving a valid Will, you will most likely require probate.

Letters of Administration

What is Letters of Adminstration?

Letters of administration is the process of applying to the Supreme Court to administer the deceased’s estate pursuant to section 14 of the Administration Act which sets out a formula as to how a deceased’s estate is to be distributed  (ie if the deceased left a spouse and children the spouse gets 1/3 plus $50,000 and the children get 2/3s).

Do I need Letters of Administration?

If the deceased did not leave a Will, or the Will is deemed to be invalid (ie was not executed correctly or they remarried or divorced after making the Will), you will most likely need to obtain Letters of Administration.

Resealing of Probate

What is Resealing of Probate?

Where the deceased’s died leaving assets situated in another State or Commonwealth country, a Grant of Probate or Letters of Administration may need is issued by a Court of that jurisdiction.

If you have already obtained the Grant of Probate (or Letters of Administration) in another State or Country, then you will need to apply for the Grant of Probate to be “resealed” in the other jurisdiction.

Do I need Resealing of Probate?

If the deceased die leaving assets in more than one jurisdiction, which is typically the case where the deceased had a share portfolio, then you will most likely need to have the Grant of Probate resealed in the other jurisdiction.
